COURT AFFIRMS JULIUS ABURE AS LABOUR PARTY CHAIRMAN

The Federal High Court in Abuja in a suit brought before Justice Emeka Nwite has ordered the Independent National Electoral Commission (INEC) to recognise Julius Abure as the substantive Chairman of the Labour Party.

Justice Nwite on Tuesday delivered the ruling validating the Abure-led leadership of the party.

He also validated the March 2024 Nnewi convention of the Party that produced the national leadership, while issuing an order compelling the INEC to recognise the leadership.

The Julius Abure-led faction of the Labour Party (LP) had accused the party’s presidential candidate in the 2023 general elections, Peter Obi, and Abia State Governor Alex Otti, of betrayal.

Abure camp had made the accusation after the Independent National Electoral Commission’s (INEC) announcement that it did not recognise Abure as the National Chairman of the Labour Party.

In a counter-affidavit filed by INEC at the Federal High Court sitting in Abuja, the electoral body responded to a lawsuit by the Labour Party, which challenged its exclusion from the commission’s refresher training for uploading party agents ahead of the Edo and Ondo governorship elections.

INEC had argued that the party’s leadership, including Abure, was invalid and that the March 2024 National Convention that re-elected Abure as chairman violated both the Nigerian Constitution and the Electoral Act.

INEC had emphasised, “It only deals with parties that have legitimate leadership in place.”

The electoral body, through its legal team led by Tanko Inuwa, SAN, also stated that the Labour Party’s suit sought declaratory reliefs that could not be granted based on admissions alone, asserting that the party needed to prove its case.

Due to the failure of the Labour Party to meet legal requirements for holding its national convention, INEC argued, the party no longer had valid leadership.

The commission had urged the court to dismiss the Labour Party’s suit, maintaining, “The Labour Party is not entitled to the reliefs it is seeking.”

The Abure-led faction in a statement issued by its spokesperson, Obiora Ifoh, had criticised those pushing for Abure’s removal, saying that many lacked the funds to purchase nomination forms ahead of the 2023 elections.

It had also been reported in May that the Labour Party crisis deepened as a Federal Capital Territory High Court issued an order barring the National Chairman of the party, Julius Abure and the National Secretary, Farouk Ibrahim from parading themselves as national leaders of the party.

Also restrained by the court from parading themselves as the national officers of the Labour are the National Organising Secretary, Clement Ojukwu and the Treasurer, Oluchi Opara.

Recall that a post-election crisis rocked the party over the suspension of Abure by the Edo State chapter of the Labour Party.

Afolabi Adekanbi and Dr. Alex Adum, we find that the respondent, Senator Samuel Anyawu, was engaged in anti-party activities contrary to the provisions of Article 58 (1)(f) of the PDP Constitution 2017 and conduct likely to disrupt the peaceful, lawful and efficient conduct of the business of the party contrary to provisions of Article 58(1)(h) of the PDP Constitution 2017, by inviting security agents and other persons and thugs to interfere in the ordinary business of the party at the Headquarters of the party, at Wadata Plaza, Plot 1970, Michael Opara Street, Wuse Zone 5, Abuja., particularly 29th January and 1st February 2025. “The NDC recommends to the National Executive Committee of the PDP as follows: Expulsion of the Respondent i.e. Senator Samuel Anyawu, as a member of the Peoples Democratic Party.” Recall that on February 6, the NDC, led by Ikimi, released a statement calling on former Governor of Benue state, Samuel Ortom, Anyanwu, and 10 other individuals to appear before the committee on Wednesday, February 12, 2025, at the Legacy House in Maitama, Abuja. The NDC’s proceedings have remained private, and the names of the other 10 invitees have not been disclosed. Efforts by The PUNCH to obtain their identities from Ikimi and the committee’ secretary, Eyitayo Jegede (SAN), were unsuccessful, as both denied knowing the individuals’ names and offered no further details. Since the 2023 presidential election, the PDP has faced internal conflicts, with accusations from members of undermining the party’s interests and calls for disciplinary action. In response, the PDP NWC established a disciplinary committee on August 21 to handle complaints, hear both sides, and make recommendations to the National Executive Committee. However, nearly five months later, the crisis has escalated, with former National Youth Leader Sunday Ude-Okoye and Anyanwu both claiming the position of National Secretary. Despite Ude-Okoye’s support from the Board of Trustees, led by former Senate President Adulphus Wabara, and the Governors Forum, chaired by Bauchi State Governor Bala Mohammed, the dispute, which worsened after zonal congresses in the South South, North East, and South East, remains unresolved, continuing to harm the party’s reputation and influence. Ortom, who raised legal concerns about the legitimacy of the petitioners, Anyanwu, who cited medical reasons, and the other 10 invitees did not attend the NDC meeting on February 12. Despite receiving invitations, both Ortom and Anyanwu, along with the others, also on March 4th failed to show up for the committee’s meeting at the Legacy House in Maitama on Tuesday. In the letter, Ikimi’s committee stated that the National Disciplinary Committee of the Peoples Democratic Party convened on February 12, 2025, and March 4, 2025, to review the petition against Senator Samuel Anyanwu, which was filed by Hon.     GROUPS VOICE OUT ANGER OVER ALLEGED PLANS TO IMPEACH FUBARA More groups are voicing out their anger over the alleged plans to use the Rivers State House of Assembly to remove Governor Siminalayi Fubara. The latest group, the Ijaw National Congress (INC), yesterday, asked the Minister of the Federal Capital Territory (FCT), Nyesom Wike, to allow Governor Fubara to concentrate on leading Rivers State to prosperity while at the same time advised President Bola Ahmed Tinubu to call the former governor to order.Speaking on Wednesday with News Night on Arise Television, the President of INC, Professor Benjamin Okaba, said something urgent must be done by the federal government to avert disaster.He spoke in the wake of a stalemate after Governor Fubara was denied access to the Rivers State House of Assembly complex to present the 2025 budget to the lawmakers who are loyal to Wike. Professor Okaba said: “President Tinubu has the choice of choosing between Wike and Ijaw Nation. Let him be encouraging him (Wike) to mess up himself in public. “Let him encourage him to be insulting people. But should the otherwise happen, they should not hold the leadership of Ijaw nation responsible. So far he wants as many structures as possible to fall and die with him, we shall help him. “He is frustrated and becoming so desperate because the political economy of Rivers State is slipping off; he will not win. Wike will not win; government is not about individuals. One person cannot be more powerful than an institution. That is the statement we are making. “We have not seen any error or crime committed by the governor. And as a true son of Ijaw nation, the INC shall apply every legitimate effort to support and defend our own,” he said. There are fears in many quarters that the crisis in Rivers State has the potential to obstruct the peace in the oil rich state, the Niger Delta and by extension, Nigeria as a whole. Also on Wednesday, an elder statesman and member of the Rivers State Elders and Leaders Forum, Anabs Sara-Igbehas, condemned the action of lawmakers of the Rivers Assembly for denying Fubara access to present the state budget to them. Sara-Igbe, who is the pioneer spokesman for the Pan Niger Delta Forum, described the action of the lawmakers as provocative and an insult to Rivers people. Speaking in Port Harcourt, Sara-Igbe, who is the National Chairman of South South Elders Forum, said denying the governor access to the Assembly complex was not an insult to Fubara as a person, but to the people of Rivers State. He said, “The governor was elected by millions of Rivers people. As the chief executive officer of the state, he has unhindered access to all the facilities within the state. Blocking him from entering the complex is a direct insult and embarrassment to the people of Rivers state. “It is now very clear that the governor is ready for peace. But these people are not ready for peace. Sara-Igbe further said that Fubara has always wanted peace; hence on the advice of President Bola Tinubu, he withdrew the case he had against the lawmakers last year even when they refused to withdraw theirs. On the comment by Wike, who during a media chat on Wednesday morning said Fubara can be impeached and “heaven will not fall”, the elder statesman reminded that pouring insults on the Ijaw people will not help the former governor and the current political situation in the state. “He should remember that during the time of late President Umaru Musa Yar’Adua, the production rate of crude dropped drastically from 2.4million barrels per day to a paltry 700,000bpd until the elders of the Ijaw nation and the Niger…
