BREAKING: PRO-FUBARA LAWMAKERS CHALLENGE APPEAL VERDICT ON PRO-WIKE GROUP AT SUPREME COURT

A faction of the Rivers State House of Assembly loyal to Governor Siminalayi Fubara, has filed an appeal at the Supreme Court to challenge Thursday’s judgement of the Court of Appeal, on the fate of 25 members of the House, who dumped the Peoples Democratic Party, PDP, for the All Progressives Congress, APC.

Factional Speaker of the House, Rt. Hon. Victor Oko-Jumbo, confirmed the development while addressing lawmakers during the plenary at a temporary facility used for legislative business in Port Harcourt on Friday.

Oko-Jumbo clarified that the action was necessitated by the fact that the Assembly “strongly believes that the Court of Appeal was in error when it held that the Rivers State High Court lacked the Jurisdiction to hear and determine SUIT NO. PHC/1512/CS/2024.”

He declared that he remained the authentic Speaker of the House because there cannot be two Houses of Assembly in Rivers State.

The factional Speaker reiterated that the seats of Rt. Hon. Martin Amaewhule and 24 other embattled lawmakers remained vacant as declared by the then speaker, Rt. Hon. Edison Ehie, on December 12, 2023, following their defection from the PDP to APC on the December 11, 2023 in contravention of extant laws.

He said: “There cannot be two Houses of Assembly in Rivers State or indeed any State in Nigeria. This House of Assembly, with me as the Speaker, is the only House of Assembly in Rivers State.

“As the whole world knows, on the 11th day of December, 2023, Martin Amaewhule and his 24 friends defected from the Peoples Democratic Party to the All Progressive Congress.

“On the 13th Day of December, 2023, Rt. Hon. Edison Ehie, as the Speaker of the Rivers State House of Assembly, declared the seats of Martin Amaewhule and 24 others in the RSHA vacant. That declaration by Rt. Hon. Edison Ehie has not been set aside by any court in Nigeria.”

Oko-Jumbo explained that the legitimate members of the Rivers State House of Assembly secured a restraining order against Martin Ameawhule and the 24 others when they continued to parade themselves as members of the Rivers State House of Assembly despite their defection from the PDP to the APC and their seats consequently declared vacant.

He said that because they felt dissatisfied with the rulings of the Rivers State High Court in Suit No. PHC/1512/CS/2024, Amaewhule and 24 others had filed an Appeal No. CA/PH/198/2024 at the Court of Appeal, Port Harcourt Division.

The factional Speaker added: “Yesterday, the 4th of July, 2024, the Court of Appeal, in its lead Judgement, allowed the Appeal by Martin Ameawhule & 24 ORS on the ground that the Rivers State High Court lacked the jurisdiction to hear and determine the case.

“Accordingly, the Court of Appeal struck out Suit No. PHC/1512/CS/2024 and NOTHING MORE. The Court of Appeal did not make any declaration that Martin Amaewhule & 24 ORS did not defect from the PDP to APC.

“The Court of Appeal also did not make any declaration that Martin Amaewhule and 24 ORS are still members of the RSHA.

“We strongly believe that the Court of Appeal was in error when it held that the Rivers State High Court lacked the jurisdiction to hear and determine SUIT NO PHC/1512/CS/2024.

“Accordingly, we have instructed our lawyers and they have filed an appeal to the Supreme Court of Nigeria challenging the judgement of the Court of Appeal delivered on the 4th Day of July, 2024.

“Martin Amaewhule & 24 ORS, in spite of all their pretences, are no longer members of the Rivers State House of Assembly, and they remain so until a court of competent jurisdiction says otherwise.

“Once again, we the legitimate members of the RSHA HEREBY call on the Independent National Electoral Commission (INEC) to promptly conduct a bye-election to fill the vacant seats in the RSHA.

“We strongly urge the general public to ignore Martin Amaewhule & 24 ORS in their pretence that they are members of the RSHA.”

Meanwhile, during the Friday’s plenary, the House considered two Bills, opened debate on them, and passed them through the first reading stage.

The Bills included the Rivers State Emergency Management Agency Bill, 2024 that was presented by the Leader of the House, Hon. Sokari Goodboy, while the second one was the Rivers State Transport Company Reform Bill, 2024, which was sponsored by the Deputy Speaker of the House, Hon. Adolphus Orubienimigha.

Commenting, the Speaker, Rt. Hon. Martin Amaewhule decried a situation where the Governor in total disregard to the Constitution and judgements of Courts transacts Legislative business withthree suspended members of the Assembly, who parade themselves as House of Assembly of the State. Rt.Hon. Amaewhule stated that the purported screening and confirmation of Commissioner – nominees for appointment, Caretaker committees and other approvals by the three impostors have been declared null and void by by the recent Court of Appeal Judgement, adding that the Governor is and his co- travellers are in contempt of the orders of the court.     SOME FIRST-TIME GOVERNORS FIGHTING THEIR GOD-FATHERS WHO MAY NOT RETURN IN 2027 Nigerian politicians have begun to debate the 2027 general elections, with each working tirelessly to secure their space in the future. However, some governors who are in their first term may lose out in the scheme of the 2027 permutations as time goes by. This is due to the fact that many of these first-time governors began their first year in office with battles rather than building alliances and structures for their political careers. Some of the battles these governors are fighting have existing structures that determine election outcomes in their state. A careful analysis of the development showed that some governors began their first year in office fighting their godfathers without them having any political structure to fall back on, while others fought first-class monarchs, which may eventually turn the people against them. Some of the governors in this category are Ahmad Aliyu Sokoto, Siminalayi Fubara, Uba Sani, Hyacinth Alia, and Abba Kabir Yusuf, to mention a few. Below are the reasons the above-mentioned governors may not have their way to the governor’s offices in their states. Ahmad Aliyu Sokoto of Sokoto state The governor of Sokoto state is one of the first-term governors in Nigeria who may not win in 2027 if tries to contest for the second term. Barely one year in office, the governor deposed about 15 emirs in the state for different offences, a development that may cost him his second-term aspiration. A few months later, the Muslim Rights Concern (MURIC) raised the alarm that the governor was plotting to depose the Sultan of Sokoto, Alhaji Sa’ad Abubakar. Though the government denied the allegation, a bill in the State House of Assembly passed the second reading. If the bill is passed into law, the Sultan would be stripped of some power, including the appointments of kingmakers and district heads, without the governor’s input. While this move may be considered constitutional because of the legislation it passed through, it can cost the governor his second term because Sokoto state and the position of the Sultan are religious sensitives. A political source in the state disclosed that the governor and his supporters never hid the impression of deposing the Sultan from their campaigns. The source stated that the ruling All Progressives Congress (APC) campaigned with a “new government, new sultan.” In an interview, Okanlawon Gaffar, a public commentator, called for respect for traditional stools in the country. He lamented: “We can’t say this is fair or not, the principle that has been exhibited is also the fact that our traditional system is now a mockery of its glory. This does not mean that our traditional system should be above the law principle. “However, it represents a different kind of leadership, where who gets to be in that position has been determined by culture and tradition.” With the growing trend, removing the Sultan could anger the majority of voters in the state, and the governor may not have the grace to win the next governorship election. Rivers Governor Siminalayi Fubara Governor Fubara of Rivers state is one of the first-time governors who may not secure re-election come 2027 due to his rift with his political godfather, Nyesom Wike, who is now the minister of the Federal Capital Territory. Fubara’s rift with Wike started barely three months into the beginning of his administration as Rivers governor, which was not considered fair enough by many political observers. However, there are insinuations that President Tinubu is supporting Fubara, which was why he appeared to have an edge above Wike.
