FUBARA OBSTRUCTING IMPLEMENTATION OF SUPREME COURT JUDGEMENT – RIVERS ASSEMBLY CLAIMS

FUBARA OBSTRUCTING IMPLEMENTATION OF SUPREME COURT RULING ON BUDGET RE-PRESENTATION – RIVERS ASSEMBLY CLAIMS The Rivers State House of Assembly has accused Governor Siminialayi Fubara of deliberately obstructing the implementation of the Supreme Court ruling, particularly the directive requiring him to re-present the 2025 Appropriation Bill to the lawmakers. In a statement issued on Sunday, the Assembly called on the public to hold the governor accountable for due process, rather than allowing him to manipulate public sentiment to cast lawmakers in a negative light. The Chairman of the House Committee on Information and Assembly Spokesperson, Enemi Alabo George, questioned Fubara’s claim that he had submitted the budget for reconsideration. “Let the governor provide proof of an acknowledged copy of the letter he claims to have sent to the House regarding the budget presentation,” George stated. According to the lawmakers, Fubara’s failure to formally re-present the budget is a direct violation of the Supreme Court’s ruling, which ordered him to follow due legislative procedure. The lawmakers urged residents of Rivers State to demand compliance with the rule of law, emphasizing that the governor’s alleged delay tactics were slowing down critical governance processes. They maintained that rather than engaging in public relations stunts, the governor should fulfill his constitutional responsibilities to ensure seamless governance in the state. George said, “Last week, we were told that on his way to Ogoni for a programme, the governor made a stopover at the gate of the House of Assembly Quarters to grant an interview to the press. “In that interview, he claimed that he had sent a letter to the House of Assembly indicating his intention to visit and present the appropriation bill, a claim we found rather astonishing as no such letter was received by the House of Assembly. “His aides later alleged that they forwarded a letter through whatsapp to some members of the House, which was also awkward, unprofessional and embarrassing. “As I speak, the social media space is awash with stories about a purported letter from the Governor to the House of Assembly expressing his intention to visit the house to present the appropriation bill for the year 2025. “Nothing can be farther from the truth. We want to state categorically that there is no such letter before the House of Assembly nor any of its staff. We challenge the Governor and his aides to produce an acknowledgement copy of such a letter or any evidence that such a letter was sent or received by the House of Assembly. It is absolutely untrue and unfortunate. The general public must as a matter of importance ignore such claim. “It is now very obvious that if at all there was such a letter, the intended recipient was not the legislature, but the public, and the clear intention was to play to the gallery, whip up public sentiment, demonize the House of Assembly and set the public against us. This is demeaning, denigrating and perilously unfortunate.” George said the governor frustrated all the efforts of the House to work with him to resolve the lingering crisis immediately after the Supreme Court judgement particularly on the aspect of presenting the Appropriation Bill in the interest of the state. He said, “Recall after the recent Supreme court judgement on the budget of our state, it became absolutely necessary for the Governor of Rivers State, His Excellency, Sir Siminalayi Joseph Fubara to present the appropriation bill to the legislature for consideration and passage. “Also recall that immediately after the judgement, this house wrote to the Governor, calling on him to immediately present the budget for speedy consideration. “It was our hope that by the 15th of March, 2025, we would have concluded the process of passing the appropriation bill into…

SUPREME COURT DISMISSES ANYANWU’S BID TO STAY EXECUTION

SUPREME COURT DISMISSES ANYANWU’S BID TO STAY EXECUTION The Supreme Court has dismissed the request brought before it by Samuel Anyanwu seeking to stay the execution of the judgment of the Court of Appeal that removed him as the National Secretary of the Peoples Democratic Party, PDP. The apex court on Monday threw out the request when Anyanwu in a dramatic turn applied for withdrawal of the request. Justice Musa Awani Aba-Aji dismissed the request when Kingsley Njemanze, a Senior Advocate of Nigeria, SAN, withdrew the request on behalf of his client. The Federal High Court and the Court of Appeal in Enugu had in concurrent judgments removed Anyanwu as PDP National Secretary. However, at Monday’s proceedings, Anyanwu backed down, urging the Supreme Court to allow him withdraw the bid to stop the execution of the judgments against. Meanwhile, hearing in the substantive matter is going on before the five-man panel of justices headed by Justice Aba-Aji. The Court of Appeal sitting in Enugu had last December upheld a Federal High Court decision that sacked Anyanwu as the National Secretary of the PDP. The appellate court subsequently upheld Chief Sunday Ude-Okoye as the substantive National Secretary of the main opposition party. In the lead judgment delivered by Justice Ridwan Abdullahi, the Court of Appeal held that Anyanwu‘s appeal was incompetent and lacking in merit. According to the appellate court, the appellant violated the PDP constitution by laying claim to the national secretary position having contested and emerged as the party’s candidate in the 2024 governorship election in Imo State. Dissatisfied, Anyanwu in February approached the apex court to set aside the judgment of the two lower courts, and recognize him as the authentic National Secretary of the PDP. He also filed a motion for accelerated hearing, as well as an abridgment of time on grounds of the crucial role of the office of national secretary.
