DISENGAGED STAFF SUE CBN, DEMAND COMPENSATION

A legal battle is brewing between the Central Bank of Nigeria (CBN) and its former employees, who were dismissed in a series of mass termination of appointments earlier in 2024.

The retrenched staff alleged that the apex bank violated internal policies, Nigerian labour laws, and their contractual rights

Represented by Stephen Gana and 32 others, the claimants filed a class-action lawsuit at the National Industrial Court of Nigeria (NICN), Abuja

The court documents claimed that their termination exercise, issued through letters titled “Reorganisational and Human Capital Restructuring”, dated 5 April 2024, contravened Section 36 of the Nigerian Constitution and the CBN Human Resources Policies and Procedures Manual (HRPPM).

The claimants argued that the process lacked the required consultation and fair hearing mandated by law.

The originating summons, filed pursuant to the NICN Civil Procedure Rules 2017 on 4 July 2024, outlines several questions for the court’s determination, chief among which is whether the claimants were denied their constitutional right to a fair hearing before and after the termination of their appointments.

They further contended that the termination letters, issued on the grounds of “restructuring,” were arbitrary, unlawful, and unconstitutional.

The dismissed employees are seeking judicial declarations that their terminations are null, void, and of no effect, insisting that they remain employees of the apex bank.

They also demanded their immediate reinstatement, payment of salaries and benefits from the date of termination, and a restraining order against any further attempts by the CBN to dismiss them outside due process.

The court filing references Article 16.4.1 of the HRPPM, which mandates consultation with the Joint Consultative Council and adherence to fair procedures before employment actions adversely affect staff.

The claimants alleged that this provision was flagrantly disregarded, as they were given just three days to vacate their positions and hand over official property.

    LAWMAKERS TACKLE TINUBU’S ECONOMIC TEAM OVER 2025 BUDGET PLAN The National Assembly has taken President Bola Tinubu’s Economic Team to task over the proposed 2025 budget, citing concerns over the disproportionate allocation of funds towards recurrent expenditure. During an interactive session on Wednesday, lawmakers from the joint Appropriation committees of the Senate and the House of Representatives grilled the Economic Team, led by Minister of Finance Wale Edun, over the bloated recurrent expenditure in the N49.7 trillion 2025 budget proposal. The lawmakers expressed dismay over the huge discrepancies in the amount of recurrent expenditure, which they argued comes at the expense of capital expenditure. They also noted the low fund releases for capital projects in the 2024 budget, which will run until June 30, 2025. The National Assembly team, led by Senator Olamilekan Solomon Adeola and Rep Abubakar Bichi, urged the Executive arm to ensure the release of adequate funds for capital projects in the 2024 budget. They argued that this is essential to serve Nigerians and make them feel the impact of the administration’s economic policies. The lawmakers pointed out that the huge recurrent expenditure only benefits a negligible segment of the population. A statement issued on Wednesday night by the Media Adviser to the chairman of the Senate Appropriation Committee, Kayode Odunaro, said the report of the Presidential Economic Team showed that the 2024 budget performance was just 43 percent, with recurrent expenditure achieving 100 percent while capital expenditure was only 25 percent. Chairman of the Senate Appropriation Committee, Senator Solomon, emphasized the need to drastically reduce the wide gap between recurrent expenditure and capital releases in budget cycles. He noted that capital releases to Ministries, Departments, and Agencies (MDAs) are the major drivers of economic activities within the nation. Meanwhile, Rep Abubakar Bichi, chairman of the House of Representatives Appropriation Committee, called for more releases for capital projects, such as schools, roads, dams, hospitals, and other social infrastructure. He argued that debt repayment, which can be restructured, should not take precedence over these critical projects. “Most of the items of recurrent expenditure which takes a huge part of our budget and is implemented 100 per cent will only directly affect about 10 per cent of our population while capital projects of the MDAs will directly affect majority of over 200 million Nigerians in areas of social infrastructure provisions like hospitals, schools, roads and energy,” Bichi said. The Minister of Finance, Wale Edun, confirmed the outstanding capital releases, blaming the non-availability of funds for the lapses. Meanwhile, the Minister of Budget and National Planning, Senator Abubakar Atiku Bagudu, attributed the huge recurrent expenditure to the nation’s low level of development and challenges confronting the nation, including spendings on insecurity. The Director General of the Budget Office, Dr. Tanimu Yakubu, also attributed the huge recurrent expenditure to past legacies inherited by President Bola Tinubu, including unpaid pensions and gratuities. He suggested legislation aimed at limiting recurrent expenditure in future budget cycles.

The Chief of Defence Staff (CDS), General Christopher Musa, made the call in a recent interview he had with Al-Jazeera. Musa said there was international flow of funding for the terrorists, stressing the need for the UN to come in to trace and track it. The defence chief, who questioned how the insurgents had sustained themselves for 15 years, also fingered international conspiracy in providing the terrorists with funds, training and equipment. Responding to a question on why Boko Haram has kept regrouping despite the claims by the federal government that the sect has been degraded, the CDS said: “The problem is that I think we have talked to the international community. Let’s find out the funding. As we speak, over 120,000 Boko Haram members have surrendered, and most of them came with hard currency. How did they get it? How are they funded? How did they get the training? How did they get the equipment? “The UN needs to come in because we need to trace the funding. It is international flow, and we don’t have control over that,” he said. Asked what his suspicion was, the defence chief said: “Well, maybe an international conspiracy… How are they being able to sustain themselves for 15 years? That is one question I think everybody should ask themselves.” The defence chief, however, said he did not know whose interest it is to see Nigeria destabilized. He noted that Nigeria is not the only country dealing with the asymmetric warfare. “West Africa, the Sahelian area, and in fact, if actions are not taken, it is going to engulf the entire world. “We are just good guys just trying to make sure that our country is secured, and then, some individuals seem not to be happy about it, and doing everything possible to throw us under the bus for whatever reasons…I have been in service for almost 33 years. Anytime we seem to be succeeding, somebody throws something at us, and the question is: why? Is it because we are succeeding or you don’t want the country to move forward? What is the aim? What’s the intent? That is the question we are asking.” He also stated that the difficulty in getting equipment was one of the reasons the insurgency had not been wiped out. “We have a procurement procedure which is being followed. And to also state that even with our monies at times, we find it difficult getting equipment. And the question is: why? One of the reasons why this insurgency has been for this long is because we have been denied access to equipment. Even when we have our monies to get it, it is difficult,” he said. On why the military had been denied access to equipment, he said: “Well, I really don’t understand. It is a question that we keep on asking, why are we being denied? “Our government is doing the best it can. But as an international system, like I said, we don’t produce (equipment), we need to buy.
