FUBARA ASKS LAWYERS TO APPEAL COURT JUDGEMENT AFFIRMING WIKE’S LOYALIST AS ASSEMBLY SPEAKER
Rivers Governor Siminialayi Fubara has instructed his legal team to appeal a recent ruling from the Court of Appeal in Abuja, which he claims does not reinstate the Assembly led by Martin Amaewhule.
In a statement released on October 10, 2024, Attorney-General Israel Dagogo Iboroma asserted that Amaewhule and 26 others lost their seats following their defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) on December 11, 2023.
According to The Nation, the Attorney-General emphasized that the issue of defection was not addressed in the Federal High Court or the Court of Appeal, maintaining that no court had validated the membership of the defectors in the Assembly.
The Court of Appeal recently dismissed Fubara’s appeal concerning the matter, which stemmed from a previous judgment in January 2024.
Iboroma noted that, according to Section 109(1)(g) of the Nigerian Constitution, the defectors automatically vacated their seats upon defection.
He urged citizens to disregard any claims suggesting that Amaewhule and others remain legitimate members of the Assembly.
Dissatisfied with the court’s ruling, Fubara plans to escalate the case to the Supreme Court and seek a stay of execution to maintain the current status of the Assembly.
He called on the people of Rivers State to be wary of misinformation regarding the situation.
