COURT ORDERS EVICTION OF FATHER MBAKA’S INVESTMENT OVER NON-PAYMENT OF RENT

An Enugu North Magistrate Court, has executed a Warrant for Possession of Premises occupied by Aqua Rapha Investment Company limited owned by fire brand Catholic Priest, Rev. Fr. Ejike Mbaka, the Spiritual Director of popular Adoration Prayer Ministry.

The company uses the rented apartment located at at No. 4 Savage Crescent, GRA, Enugu as depot for wholesale business distribution of her products at the heart of Enugu metropolis, but allegedly defaulted in paying the rent.

The eviction judgment pronounced Friday, which lasted several hours, saw the company’s products, equipment, files and other documents evacuated from the building and dumped on the major road just opposite Shoprite main gate in Enugu.

While executing the eviction order, the court bailiff also recovered a sales vault containing a total cash of N773,520 before sealing and putting the building, which hitheto served as wholesale apartment of the company, under lock and key.

Explaining what led to the eviction, the Counsel to Dr. and Mrs Ben Ogbu, Barr. James Edeh, said that his client, the property owners, were tried of the unfaithfulness of the managers of the company in paying agreed rent as contained in the signed tenancy agreement.

He noted that the company failed to abide fully with the initial three years tenancy agreement entered into in 2016 which elapsed in 2018.

“The company failed to pay an agreed installment of N300,000 meant for rent for 2017 and 2018 after paying that of 2016 and lump sum of the tenancy agreement,” .

“Even when the initial agreed tenancy elapsed in 2018, the company find it difficult to come and renegotiate the agreement but waited after we took them to court to come and drop N4 million without renegotiation or signing a fresh agreement to be supervised by me.”

“Before paying the N4 million after being in oblivion for some years, the company representative, Mr Nwankwo, was instructed to meet with me as the lawyer managing the property but he did not abide by the simple instruction.

“We have been in court since 2020 on this matter and we have repeatedly served the company and its lawyers; they only appeared once and no more. After waiting and being patient for many years, the court issued a Warrant for Possession of Premises by the original owner.”

Reacting to the development , lawyer to Aqua Rapha Investment company Ltd, Barr. Fidelis Okeke, said that the eviction was unfair, adding that “This is unlawful execution”.

Okeke said , the company was up to date with its rent payment, saying we have paid everything.

“I will go back to my chamber and study everything concerning this embarrassing execution and I will assure you it will not stand. By Monday, I will be in court to challenge this.“The company will surely seek redress in court and claim huge damages for this insult and reputation damage,” he stated.

He noted that Dangote has capacity to manage his privately-owned refinery effectively, contrasting it with the government’s inefficiency. Obasanjo said, “I asked Shell to come and run it for us and Shell said they wouldn’t I said, Please come and take equity they said no. I said okay, don’t take equity, come and run it, they said no. “Later on, I called them. I called the boss of Shell to come and tell me what the problem was and he gave me four or five reasons. He said, first of all, they make a major profit from upstream, not from downstream. He said they run downstream just to keep their head above water. “Two, our refineries were too small: 60,000 barrels 100,000 barrels and I think 120,000 barrels. He said that at that time, the average refinery was going for 250,000 barrels. “Three, he said our refineries were not well maintained. Four, he said that there was too much corruption around the activities of our refinery and they would not want to get involved in that. “Aliko got a team together and they paid $750m to take part in PPP (Public–Private Partnership) in running the refineries. My successor refunded their money and I went to my successor, I told him what transpired, he said NNPC said they wanted the refinery and they could run it and I said but you know they cannot run it. “I was told not too long ago that since that time, more than two billion dollars have been squandered on the refinery and they still will not work. “If a company like Shell tells me what they told me, I will believe them. If anybody tells you now that it is working, why are they now with Aliko? And Aliko will make his own refinery work; not only make it work, he will make it deliver.”

    NEW WITHHOLDING TAX BEGINS President Bola TinubuThe Federal Government has commenced the implementation of the 2024 Withholding Tax Regulations, signalling effort to modernise Nigeria’s tax system. Approved by President Bola Tinubu in July 2024 and published in the Official Gazette in October, the revised regulations became effective on January 1, 2025. Formally titled the “Deduction of Tax at Source (Withholding) Regulations, 2024,” the updated regulation is designed to streamline compliance processes, reduce inefficiencies, and ease administrative burdens for businesses. These changes are particularly aimed at Small and Medium Enterprises, manufacturers, producers, and farmers – sectors considered vital to Nigeria’s economic stability and growth. Announcing the commencement of the new tax regime on New Year’s Day, the Chairman of the Presidential Committee on Fiscal Policy and Tax Reforms, Taiwo Oyedele, said on his X (formerly Twitter) account, “As part of the ongoing fiscal policy and tax reforms, the 2024 Withholding Tax Regulations, which was approved in July 2024 and published in the Official Gazette in October 2024, take effect today 1 January 2025.” He further highlighted several transformative features of the updated policy. Among them is the exemption of SMEs from withholding tax compliance, a move expected to alleviate administrative challenges and financial constraints, thereby fostering growth and innovation in the sector. Businesses with low-profit margins will also benefit from reduced withholding tax rates, which are intended to improve cash flow and lower operational costs. The new regulations exempt manufacturers, producers, and farmers from withholding tax obligations, a measure aimed at strengthening these critical sectors to ensure their sustainability and long-term growth. Also, the reforms streamline the process of obtaining credit for taxes deducted at source, making it easier for businesses to utilize such deductions efficiently. By addressing longstanding issues, such as ambiguities in the timing of deductions and definitions of key terms, the updated regulations eliminate barriers that previously made compliance difficult. The reforms are also designed to curb tax evasion, minimize avoidance opportunities, and enhance transparency in tax remittance. The PUNCH earlier reported that the Federal Government unveiled new tax regulations aimed at reducing the tax burden on the manufacturing sector and small businesses. This was disclosed in the “Deduction of Tax at Source (Withholding) Regulations, 2024,” signed by the Minister of Finance and Coordinating Minister of the Economy, Wale Edun. The Deduction of Tax at Source (Withholding) Regulations, 2024, aim to streamline the deduction of taxes at source from payments to taxable persons, reduce complexities, and promote ease of compliance for businesses. The newly introduced regulations cover payments made under the Capital Gains Tax Act, Companies Income Tax Act, Petroleum Profits Tax Act, and the Personal Income Tax Act. Earlier, Oyedele revealed that the highest-earning Nigerians could soon pay over N1m monthly in Pay-As-You-Earn tax under the proposed tax bills aimed at correcting fiscal inequities and simplifying the system. He disclosed this in a series of tweets on his official X account on Monday. Oyedele stated that the proposed changes would address the regressive nature of the current tax structure, which has remained unchanged since 2011. He explained that inflation over the years has caused “fiscal drag,” pushing many low-income earners into higher tax brackets. For instance, under the current system, an individual earning N400,000 per month pays the same top marginal tax rate as someone earning N20m monthly. The proposed framework seeks to restore progress, ensuring that high-income earners pay their fair share while providing relief to low- and middle-income earners. The proposed tax bills raise the tax-free threshold to N800,000 annually, equivalent to N67,000 monthly, compared to the current N300,000 threshold.
