WIKE, FUBARA, WAR GETS HOTTER AS FOUR COMMISSIONERS QUIT GOVERNOR’S CABINET Four Commissioner serving in the administration of the governor of Rivers State, Sir Siminalayi Fubara, have since resigned their appointments into the State Executive Council. Whereas the Commissioner for Works, George Kelly, and the Commissioner of Power, Henry Ogiri, had earlier resigned, the Attorney General and Commissioner of Justice, Prof. Zacchaeus Adango, and the Commissioner for Finance, Isaac Kamalu resigned yesterday. Kelly and Ogiri had resigned following their appointment by the federal government, while Kamalu and Adango, resigned following their redeployment out of their ministries to another. The state governor had in a circular signed by the Secretary to the state government, Dr Tammy Danagogo, approved that the Attorney General and Commissioner for Justice, Prof. Zacchaeus Adangor, be moved to Ministry of Special Duties (Governor’s Office). The governor also ordered that the Commissioner for Finance, Barr. Isaac Kamalu, be redeploed to the Ministry of Employment Generation and Economic Empowerment. The two redeployed commissioners had rejected their transfer to other ministries, noting that the peace sought for in the state was yet to be attained. The Attorney General and Commissioner of Justice, Rivers State, Prof. Zacchaeus Adango, who rejected his redeployment from the Ministry of Justice to that of Special Duties (Governor’s Office) noted noted that his decision was for the sake of his integrity. Adango, had earlier in the wake of the political war between Fubara and the Minister of the Federal Capital Territory, Chief Nyesom Wike, resigned his position, but later was restored to his position following the intervention of President Ahmed Bola Tinubu. It was gathered that after the restoration of Adango, that he has not been in the good books of the governor of the state, following his continuous loyalty for the FCT Minister. Adango in his resignation he captioned, ‘Cabinet Reshufflement: Notice of Rejection of Deployment and Resignation from the Rivers State, Executive Council, noted that he was not consulted before his deployment. It read: “My attention has been drawn to your letter dated 23rd April, 2024 and widely circulated on social media whereby I was “deployed to the Ministry of Special Duties (Governor’s Office). “Further to the referenced letter, I hereby give you notice of my rejection of the said deployment and resignation from the Rivers State Executive Council with effect from 24th day of April, 2024. “I wish to state for the record, that I am no longer willing to continue to serve in the administration of His Excellency, Sir Siminalayi Fubara, GSSRS, Governor of Rivers State, in any capacity whatsoever. “It is important to mention that the Governor of Rivers State had in the past couple of weeks willfully interfered with the performance of my duties as the Honourable Attorney-General and Commissioner for Justice, Rivers State by directing me not to defend, oppose, or appear in suits instituted against the Honourable Attorney-General and the Government of Rivers State by persons admittedly hired and sponsored by the Government of Rivers State. “That having served the Government and good people of Rivers State dutifully as member of the Rivers State Executive Council for the past five (5) years, it has become imperative for me to quit the administration in order to preserve my reputation.” However, on Wednesday, Kamalu tendered his resignation from the cabinet, noting that the peace instituted by President Ahmed Tinubu is not yet in sight. NASS GRANTS FINANCIAL AUTONOMY TO 774 LOCAL GOVT COUNCILS The National Assembly on Tuesday has in a landmark move amended section 124 of the nation’s constitution granting full financial autonomy and administrative autonomy to all the 774 local council authorities across Nigeria. Similarly, the amendment scrapped the existence of State Independent Electoral Commissions (SIECs) from the constitution. By this development, the Independent National Electoral Commission (INEC) will henceforth conduct local government elections and the LGs will be free to handle their finances individually. The National Assembly also made provisions for independent candidates in future elections in Nigeria by amending sections 65 and 106 of the 1999 constitution. Section 124 of the constitution provides a consequential provision for the making of the local councils a full third tier government without undue interference from the state governments. The amendment was one of the 22 others approved by the House of Representatives last week and ratified by the Senate on Tuesday. Both chambers had through a conference committee harmonised versions of the amendments in the constitution carried out by each of them last month. By the development, the National Assembly had ratified all the 23 clauses and sections that had been amended by both chambers. The newly amended document which would be sent to the State Houses of Assembly, for approval, also approved the creation of the Office of Auditor General of the Local Government as well as the State Local Government Service Commission. However, immunity clauses for the President and Governors were retained in the constitution by adopting the Senate version of the amendments on the issue and rejecting the House of Representatives version which removed the immunity clause. There have been various agitations since the new dispensation of democratic rule to grant autonomy to the Local Government in Nigeria.This has been largely been driven by the lampooning of Local Governments by many State Governors to fail to conduct elections for the LGs and also hold on to the funding of the LGs hence resulting in the ineffectiveness of the LGs.

He assured that anybody obstructing the arrest of the former Kogi State Governor will be brought to justice.Olukoyede said the EFCC needs the support of Nigerians to succeed as he emphasised that if the agency fails, Nigeria fails. A member of his legal team, Mr. Adeola Adedipe, SAN, told the court that his client would have made himself available for the proceedings, but was afraid that he would be arrested. “The defendant wants to come to court but he is afraid that there is an order of arrest hanging on his head,” Adedipe, SAN, submitted. Consequently, he urged the court to set aside the exparte order of arrest it earlier issued against the former governor. Adedipe, SAN, contended that as at the time the order of arrest was made, the charge had not been served on his client as required by the law. He noted that it was only at the resumed proceedings on Tuesday that the court okayed substituted service of the charge on the defendant, through his lawyer. “As at the time the warrant was issued, the order for substituted service had not been made. That order was just made this morning. “A warrant of arrest should not be hanging on his neck when we leave this court,” counsel to the defendant added. Besides, the ex-governor maintained that the EFCC is an illegal organization. According to him, the Federal Government did not consult the 36 States of the federation before it enacted the EFCC Act through the National Assembly. He argued that section 12 of the 1999 Constitution, as amended, required the various Houses of Assembly of states to ratify the Act before it could become operative. “This is a very serious matter that borders on the constitution and the tenets of federalism. It has to be resolved because as it stands, the EFCC is an illegal organization,” Bello’s lawyer added. However, EFCC’s lawyer, Mr. Kemi Pinheiro, SAN, urged the court to refuse the application, insisting that the warrant of arrest should not be set aside until the defendant makes himself available for his trial. “The defendant cannot stay in hiding and be filing numerous applications. He cannot ask for the arrest order to be vacated until and when the defendant is present in court for his arraignment. He cannot be heard on that applied application. “The main issue should be ascertaining the whereabouts of the defendant. All these applications he is filing are nothing but dilatory tactics intended to delay his arraignment and frustrate the proceedings. “If he wants the order of arrest to be discharged, let him come here and make the application. “Our position is that the defendant should be denied the right of being heard, until he is physically present before this court.” EFCC’s lawyer further argued that inline with section 396 of ACJA, 2015, the court could not effectively assume jurisdiction to decide any application or objection in the matter, until the defendant is arraigned. The anti-graft agency said it would not execute the arrest warrant if counsel to the defendant undertake to ensure his presence on the next adjourned date. “If he gives an undertaking that his client will be in court on the next date, I can assure him that the arrest warrant will not be executed. “If he gives that assurance, as the prosecution, I will personally apply for the warrant to discharged,” EFCC’s lawyer, Pinheiro, SAN, added.
